Special needs trusts permit gifts, devises and litigation recoveries to benefit individuals with serious disabilities without jeopardizing key government aid. Individuals with serious disabilities often qualify for government benefits like Supplemental Security Income, Medicaid, Division of Developmental Disabilities residential placements and day programs and housing aid. However, estate plans and personal injury recoveries are usually disqualifying unless they include special needs trusts.
