The Inaugural NJSBA AI Institute
Artificial intelligence is becoming integral to the practice of law. It is quickly evolving from a new technology that can cut costs and increase efficiency to one that can directly impact the practice by drafting documents and pleadings, assist in litigation or create documents that will be entered into evidence. Because AI is fast-moving and developing rapidly, it will soon be essential for lawyers and judges to have a working knowledge of AI.

Session 1 – Attorneys and New Technologies: An Intro Course
Wednesday, Sept. 25 | 12 – 1:40 p.m.
Generative artificial intelligence (GAI) is the latest technology that may transform how attorneys practice law. However, attorneys are confronted with new technologies on a regular basis and should be prepared to evaluate and make use on anything “new.” This session will propose an approach for attorneys to consider any new technology with their ethical obligations in the forefront.

Session 2 – Benefits and Risks of AI/GAI: Causes of Action and Defenses

GAI carries benefits as well as risks, both known and foreseeable. These benefits and risks may – and indeed have already – given rise to civil actions under various federal and state theories of liability. This session will examine those benefits and risks and explore causes of action arising from the use of GAI and well as defenses to liability.

Session 3 – How AI/GAI Might Assist Attorneys in Litigation

GAI burst onto the scene a short time ago. Since then, it has been touted as a technology that will transform us in many ways, including business operations and interpersonal relationships. Will GAI transform how litigation is conducted in terms of legal research, data review and production, and trial strategy? This session will examine these and other potentially “transformative” uses of GAI.

Session 4 – Discovery of AI/GAI: Possible Requests and Objections
Wednesday, Dec. 18 | 12 – 1:40 p.m.
GAI will invariably become relevant to claims and defenses in litigation. For that reason, discovery will be sought about GAI, both because it may be relevant to a claim or there will be challenges to how it’s used to provide discovery. This session will consider GAI as a subject of discovery.

Session 5 – AI/GAI in Criminal Investigations and Proceedings
Wednesday, Jan. 22, 2025 | 12 – 1:40 p.m.
GAI, as with any technology, may be used for good and bad purposes. Those bad purposes may give rise to investigations and prosecutions for criminal activity, as we have seen with deepfakes involving child pornography. This session will examine known or foreseeable GAI-related crimes, the nature of investigations into and prosecution of such crimes, discovery of the fruits of those investigations, and relevant principles under the federal and New Jersey Constitutions.

Session 6 – Admissibility of AI/GAI Under Accutane and Olenowski
Wednesday, February 26, 2025 | 12 – 1:40 p.m.
Daubert has now been adopted by the New Jersey Supreme Court in both the civil and criminal context. This raises the question of how expert opinion and GAI-derived evidence will be evaluated under Accutane and Olenowski. This session will address the need for and nature of experts who offer opinions on GAI, the standard for admissibility of GAI-related opinion and evidence, and the roles of judge and jury.

Session 7 – The Ethics of AI/GAI Use by Attorneys
Wednesday, March 12, 2025 | 12 – 1:40 p.m.
GAI’s use by attorneys implicates a number of ethical obligations. These obligations begin with the duty of competence and continue through the Rules of Professional Conduct. This session will examine those rules, how the rules apply to GAI, and suggest measures that might be taken by attorneys to discharge their ethical obligations in the context of GAI.
