This will be a general business meeting for the members of the Business and Commercial Litigation Committee.

 

Agenda:

Committee Activity Review (Past 6 Months)
We will review the committee’s recent activities, including our December 4, 2025 CLE program and our January 2026 reception with the Complex Business Litigation Program judges and clerks.

 

Current Initiatives
We will discuss our upcoming panel for the NJSBA Annual Bar Convention in Atlantic City, tentatively titled “Ugly Business Divorces: How to Avoid Them, Resolve Them, and Win Them” (scheduled for May 13 from 3:45–5:15 p.m.).

 

Midcycle Report – Rules of Evidence (Request for Committee Input)
The New Jersey Supreme Court is seeking comments on the Midcycle Report from the 2025–2027 Committee on the Rules of Evidence. The primary issue is whether to amend N.J.R.E. 702 to align more closely with Federal Rule 702 regarding expert testimony.

 

The Committee on the Rules of Evidence has recommended against adopting the federal-style amendments, concluding that New Jersey’s current rule and case law are sufficiently clear and that any concerns are better addressed through judicial training rather than rule changes.

 

We will discuss whether our Committee wishes to submit any comments or recommendations to the NJSBA Board of Trustees, which will consider this issue at its April meeting. Please note that any feedback should be finalized by April 15.
