As artificial intelligence becomes increasingly integrated into legal practice at a rapid pace, lawyers continue to navigate a complex ethical landscape that goes well beyond hallucinations, bias, and other challenges that have quickly become ubiquitous in discussions of AI ethics. This program will explore the nuanced and complicated ethical implications of AI use, with a focus on available guidance including the Rules of Professional Conduct, recent court decisions, and guidance issued by state and local bar associations. Recent developments from the last twelve months will be explored, including: the duty of competence in using generative AI tools; the intersection of ethics and the question of ownership of AI outputs; confidentiality and data privacy risks; issues related to the duty to report misconduct; and, the importance of supervision and human oversight to avoid faulty reliance on inaccurate or fabricated outputs. The session will also address cybersecurity vulnerabilities introduced by AI platforms and the cross-border implications of data sharing and AI-generated content. Attendees will gain concrete strategies and practical insights into developing responsible AI policies, supervising AI use within legal teams, and maintaining client trust in an evolving technological environment while remaining in good ethical standing.
