The New Jersey State Bar Association is disappointed that the state’s ongoing judicial vacancy crisis will force civil and matrimonial trials to halt in another New Jersey county. The upcoming moratorium in Passaic County will directly impact families in custody, parenting time and child support disputes, and leave civil litigants – including victims of discrimination, automobile injuries and medical malpractice – with little recourse as their cases stall. It is unfortunate that good news in the resumption of civil and matrimonial trials in Vicinage 15 is met with another suspension and the extension of the trial moratorium in Vicinage 13. The ongoing efforts to nominate and confirm more Superior Court judges in New Jersey simply have not kept pace with the rate of vacancies. With every step forward, the Judiciary has been forced to take a step back.
The NJSBA continues to demand that state leaders fulfill their Constitutional duties and return the Judiciary to a co-equal branch of government by confirming a full complement of judges. To prevent further harm to New Jersey residents, it is imperative that the Governor nominate and the state Senate provide advice and consent on qualified judicial candidates immediately. The fact that some nominees have been approved by their home senators but not given a hearing in the Senate is irresponsible.
