NJICLE is pleased to announce that Jack Fersko, Esq., David S. Gordon, Esq. and Christopher D. Hopkins, Esq., three of the state's respected commercial real estate attorneys, have joined together for another year and designed a brand-new full day program to provide you with knowledge of leasing topics that are so critical to the commercial real estate lawyer.

This year, the program will address a broad spectrum of important and sophisticated subjects that all real estate lawyers need to understand to practice in today’s competitive commercial leasing marketplace.  We will start the day off with an opening segment addressing unusual asks – what landlords and tenants should but don’t always address, which will be followed by discussion of lease termination and enforcement issues, property condition issues to address going in and coming out of a lease, additional rent pass-through issues, the increasingly important issue concerning the use of AI in commercial lease transactions, and we will end the day with a discussion concerning the ever present issue of leasehold financing from each of a landlord and tenant perspective.  Whether leasing is your specialty or just an integral part of your transactional business practice, enhance your skills by hearing from panelists with years of experience discuss these critical leasing issues that they deal with on a regular basis.

Program Agenda:

  • Unusual Asks: What Asks Should a Tenant Make, that it Never Does, But a Landlord Will (Should) Give; What Asks Does a Tenant Regularly Make, that a Landlord Will Not (But Should) Give - Charles Applebaum, Esq.; Jack Fersko, Esq.; David H. Gibbons, Jr., Esq. and Peter Visceglia, Esq.
  • Lease Termination and Enforcement Issues - Hon. Robert J. Mega, P.J. Ch. (Ret.) and Luke J. Kealy, Esq.
  • Going In – Going Out: Tenant Improvements, Removal Restrictions, Condition on Surrender, Credit Enhancements (for Landlords and Tenants) - Christopher D. Hopkins, Esq. and Jan Alan Lewis, Esq.
  • Additional Rent Pass-Through Issues: What Gets Passed Through (insurance, taxes, CAM charges, etc.), Carve Outs, Capital Expenses, Base Year, Gross-Up of Additional Rent Items, Controllable Expense, Caps on Annual Increases in Additional Rent - Martin F. Dowd, Esq. and Joseph J. Whitney, Esq.
  • Use of AI in Commercial Lease Transactions - J. Cliff McKinney, II, Esq.
  • Keep the Money Flowing: Leasehold Financing Issues from a Landlord and Tenant Perspective - Adriana M. Peters, Esq. and Charles J. Wilkes, Esq.
