The foundation of our justice system is fairness. We achieve fairness by ensuring each litigant receives equal treatment and cases are adjudicated justly and equitably. When dealing with people of diverse cultural backgrounds, there are additional considerations necessary to ensure fairness.
Challenges to fairness are possible in all parts of the court system, whether in criminal, family, civil law and at all stages of a case. For instance, there may be a language barrier, or considerations related to religious and cultural practices such as wearing a hijab or yarmulke in court.
Our distinguished panel will discuss a range of considerations and examples in three specific contexts:
