Trust and estate attorneys rely on paralegals and legal assistants to perform many important tasks. For estate planning, that includes the client interview, information gathering and drafting documents. For estate administration, this includes preparing and filing probate documents, contacting beneficiaries and next of kin, administering accounts and preparation of estate tax returns.
This program is designed for paralegals and new attorneys who handle estate planning and estate administration matters or are transitioning to this practice area.
This year’s program will include a segment on taxes, including filing Form 706, the Estate and Generation-Skipping Transfer Tax Return, the Form 709 Gift Tax Return and Form 1041, a federal tax document used by an executor, administrator or trustee to report the income, deductions, gains and losses generated by a decedent’s estate or trust after death before assets are fully distributed.
Topics include:
- Information gathering – specific questions to ask and issues to discuss in client intake
- Basic asset valuation and significance of different types of assets
- Will mechanics – overview of “simple” wills and the reason for some of the most common clauses
- How to save clients money on taxes – pitfalls even some accountants don’t know
- The purpose of Forms 706, 709 and 1041, and what you should know about how to file each
- Overview of probate procedures
- Probate documents – applications, filings, letters testamentary, and more
