The year 2024 has been especially significant for residential real estate practitioners, with many changes that directly affect the practice. The Real Estate Consumer Protection Enhancement Act took effect on Aug. 1, requiring new responsibilities for brokerage firms, buyers’ agents, sellers’ agents and anyone who helps consumers buy and sell real estate. For example, buyers now need to sign a representation agreement with their agent before starting the homebuying process, outlining how the agent will be compensated for their work. Also, the “standard” 6% commission is no longer be required to be paid by seller. Additionally, the Flood Hazard Disclosure Law –which took effect in March – requires every seller to disclose specific flood risk information via a property condition disclosure statement.
These are just a few of many impactful changes that alter the attorney’s role and obligations in residential real estate transactions.
