Traditionally, there have been three basic estate planning documents in New Jersey (Will, Power of Attorney and Health Care Directive). Now, there are many inquiries about trusts due in part to the surge in online material telling everyone that they need a trust in addition to a Will. Should our clients believe everything they read? This program will explore some of the common reasons clients give for wanting a trust. We will separate fact from fiction about what a trust can accomplish that a Will alone cannot. Does the client really need a trust? We will take a deep dive into the most common type of trust- the Revocable Living Trust.
In this new program, you will learn about contesting a Living Trust versus a Will and whether the Notice of Probate rules apply to Living Trusts.
Topics include:
- When is a trust actually needed by a client
- How to deal with clients that insist on a trust regardless of need
- Revocable Living Trusts
- Contesting a Living Trust and appliable Rules
