Veterans Diversion Programs in the Municipal Court

Veterans appearing in municipal court may face legal issues that intersect with service-related experiences, mental health, substance use, and access to veterans' benefits and services. Veterans Affairs diversionary programs can provide an important avenue for addressing these underlying issues while promoting accountability and rehabilitation.

This CLE will provide a practical, multidisciplinary examination of Veterans Affairs diversionary programs in the municipal court setting. The panel will discuss the legal framework, eligibility considerations, referral and screening processes, and practical challenges that arise when identifying and assisting veteran defendants. The panel will also explore the distinct perspectives and responsibilities of the court, prosecution, and defense, including considerations surrounding treatment, compliance, confidentiality, veterans' benefits, and successful reentry into the community. Attendees will gain practical guidance for recognizing veterans who may benefit from available programs and navigating the diversion process while balancing due process, accountability, and rehabilitation. The program is intended to equip municipal court practitioners with a greater understanding of available resources, diversionary programs, and practical strategies for effectively addressing municipal court cases involving veterans.

Please note, the CLE presentation will take place from 5:00-6:00 p.m. followed by a general business meeting for the members of the Municipal Court Practice Section.
