Cyber Security and Water Utilities

In February 2021, an unknown hacker bent on chaos gained remote access to the controls at a water treatment plant in Florida. The infiltration took just a few moments. Shortly after the hacker gained control, the level of sodium hydroxide (also known as lye or caustic soda) used to treat water at the plant began to increase – from a safe level of 100 parts per million to the extreme level of 11,100 parts per million. At low levels, sodium hydroxide helps manage the PH level of water. At high levels, if ingested, the chemical results in severe burns to human tissues and can cause blindness or even death. This is not the plot of a Tom Clancy novel, but an actual cyber-attack that occurred in Oldsmar, Florida. Fortunately, the intrusion was detected before any harm occurred.

The panel will address how increasingly novel and sophisticated cyber security threats impact water utilities – especially in relation to Supervisory Control and Data Acquisition (“SCADA”) systems, which are systems that allow for remote monitoring and control of water/wastewater infrastructure and that can include functions such as adjusting the dosage of chemical treatment in the water. We will focus on topics such as what are the requirements for water/wastewater utilities in NJ with respect to cyber security in New Jersey? How are water utilities working to prevent cyber-attacks? What are the Board of Public Utilities and the State doing on this front? What happens when an attack occurs? How can the water industry and regulators stay one-step ahead of the bad guys?

This CLE presentation will be followed by a brief general business meeting. Refreshments will be provided by Saul Ewing LLP.
