Recent Ballot Design Litigation in New Jersey: Impacts on the 2024 Election and Public Utility Law
In the wake of the spring 2024 decision where U.S. District Judge Zahid Quraishi granted the preliminary injunction sought by Rep. Andy Kim and two Congressional candidates to eliminate the county line. The county line is a feature unique to New Jersey elections that’s given local party officials inordinate influence over elections. In 19 of 21 counties in the state, candidates backed by county political parties appear in a single column or row, placing them more prominently on primary ballots and giving them a nearly insurmountable edge. There have been several settlements since the decision was made and the Speaker and Assembly Minority leader just announced late last week the creation of a select committee to review the ballot design process. We will discuss impacts of the "county line" decision on the 2024 election and potential impact on public utility law in the state.
