The government's ability to seize private land, with just compensation, for public purposes is a powerful tool. The Federal and New Jersey Constitutions limit the government's ability to take property, as does case law. Our program reviews the statutory and case law framework relevant to New Jersey's eminent domain practice. The program discusses how governmental entities can seize private property and the Court decisions that have curbed that power by insisting that condemners articulate the necessity, public purpose, and foreseeability of a project's completion.
