"Crimmigration" is a complex area, full of traps for the unwary. Learn how to avoid them in our timely program. This program features extremely experienced faculty who will teach you to navigate through deportation land mines. They will use real-life examples and hypotheticals to demonstrate how to avoid exposure to ineffective assistance claims while providing your clients with the best representation possible.
The crossover between immigration and criminal law is complex and requires a unique set of strategies to get the best results for your clients. Criminal convictions can change immigration status and have life-altering ramifications for your clients. Before entering a plea on behalf of a client or representing one at any stage in a criminal case, even in municipal court, attorneys must understand the consequences criminal convictions can have on immigration status and know how to proceed in a criminal matter, keeping in mind that deportation risks are possible.
Top immigration lawyers and criminal defense attorneys -- who have represented foreign nationals charged with a host of offenses -- offer their expert advice with this informative program. The panel will share best practices for helping clients facing criminal charges in municipal, state, and federal courts. Case studies will illustrate the importance of knowing the law or risk exposure to claims of violating your client's Sixth Amendment rights.
Practitioners must also provide competent representation in Immigration Court under the Fifth Amendment guarantee of due process. The panelists will offer guidance on how to prepare cases for foreign nationals facing removal for crimes. And finally, the discussion will cover what to expect next in the world of post-conviction relief in New Jersey and other states and new, related developments in the Biden administration.
