When the term “long-term care” is used, most people think nursing homes. There are, however, a myriad of facilities and care arrangements licensed in New Jersey, and these are often referred to as alternative care facilities. They include assisted livings, residential health care facilities, dementia care facilities, group homes and more. Not everyone in long-term care is an older adult or has the same care and/or supervision needs. However, as the population ages and licensed long-term care expands in New Jersey, more families are faced with potential issues related to care standards, violations of those standards, and severe injuries their loved ones suffer under the care of others.

Join two experienced attorneys, one who handles plaintiff matters and one defense, as they present this insightful seminar on handling alternative care facility disputes and litigation. They will address current legal concerns that include abuse, neglect, physical and sexual assault, and understaffing, along with care related injuries including pressure ulcers, over or under medication, falls and wandering and elopement. They will review the types of facilities, define the standard of care, and delve into how to prove or defend a suit involving alternative care facilities. You will leave the program with information you can immediately use.

Topics include:

  • The different types of facilities and how the differences affect your case
  • Questions to ask during the client interview
  • Defining the standard of care
  • Different causes of action and the proofs needed for each
    • Inadequate staffing
    • Inadequately trained staff
    • Overuse of antipsychotic medications or sedatives
    • Failure to supervise violent clients
    • Failure to supervise wandering clients (“elopers”)
    • Physical conditions of the facility
  • Methods for identifying and investigating or defending claims of abuse or neglect
  • Tips for trying the case
  • And more
