Electronic discovery has evolved rapidly in the past few years. Today’s process is not just about sifting through mountains of disorganized files – it leverages advanced digital tools and artificial intelligence. AI has become a critical part of the attorney’s toolkit, enabling faster searches across computers, servers, mobile devices, and cloud systems. This evolution offers substantial efficiency gains while also raising important questions about reliability, transparency, and the limits of technology.
AI Can Enhance E-Discovery, But It's Important to Understand the Challenges it Presents
Overreliance on AI may introduce risks such as algorithmic bias, lack of transparency, and challenges in establishing the evidentiary weight of AI-derived searches. As courts begin to scrutinize these methods, it is vital to balance innovative approaches with traditional, trusted legal practices. In this program, you will review the court rules, legislative updates, and case law impacting AI-assisted discovery while addressing both its benefits and its limitations.
As An Attendee, You’ll Hear Top Experts Review the Key Strategies You Need to Know, Including:
- Data Management: Creating, storing, and retrieving electronic information in an AI-driven environment.
- Legal Framework: Analyzing the legislative and case law developments governing AI-assisted discovery.
- Data Requests and Integrity: Managing electronic data requests while ensuring data integrity and chain of custody.
- AI Methodologies: Evaluating the discoverability and transparency of AI search processes.
- Ethical Considerations: Addressing privacy, security, and ethical concerns in the digital age.
- Expert Collaboration: Identifying and working with AI specialists and external consultants.
- Practical Tools: Accessing updated sample forms for subpoenas, motions to compel, protective orders, and preservation letters.
- Judicial Perspective: AI challenges and pitfalls (the importance of human oversight).
- Judicial Perspective: Digital evidence integrity (maintaining a continuous chain-of-custody and rigorous authentication, with technology supplementing rather than replacing traditional review).
Prepare your e-discovery strategy for a rapidly evolving landscape where technology meets the courtroom, ensuring you stay ahead.
