NJICLE, in cooperation with CNA Insurance, presents a seminar designed to help New Jersey attorneys gain insight into how to avoid malpractice claims and ethics grievances, and save money on legal malpractice insurance premiums - including a 7.5% discount for CNA policyholders on a per-attorney basis.

The current legal market presents various opportunities for risk-conscious entrepreneurs to develop law firm strategies that meet the needs of the modern client. This program will offer effective strategies to manage risk related to bringing on a new or prospective client. The program will also provide valuable insight on how to get maximum benefit from your professional liability insurance policy by reviewing its important features, along with the dangers of dabbling in unfamiliar areas of the law. Finally, the course will offer strategies to manage legal malpractice exposures from support staff, outside vendors and the emerging enigma of artificial intelligence.

  • Proper client intake protocols
  • The unintended formation of the attorney-client relationship
  • The importance of the written engagement agreement
  • Client red flags to avoid
  • The risks of dabbling in unfamiliar areas of the law
  • The ethical rule of competency
  • The concept of "crossover" within the context of dabbling
  • The significance of reporting both actual and potential claims to the professional liability insurance carrier
  • Review of common errors that lead to claims, along with real-life claim examples
  • How your professional liability insurance carrier can help if you are confronted with a disciplinary complaint or subpoena
  • Legal malpractice exposures presented by support staff and outside vendors
  • RPC 5.3 ethically managing law firm support staff
  • RPC 1.4 communications with the client regarding the role of support staff and outside vendors
  • Problems created by AI: potential disclosure of client confidences and hallucinations
