Even if you think you know the mechanics of proper attorney trust/IOLTA and business accounting, you will benefit from this three-hour course which includes an in-depth look at the requirements of the court rules and Rules of Professional Conduct associated with proper recordkeeping and safeguarding client trust funds. In addition, presenters will include a discussion of misappropriation, some facts about the types of funds which should and should not be placed into a trust account, as well as providing an opportunity for you to see specific samples of the required accounting records, including a closer look at the preparation of monthly three-way trust account reconciliations. You will also learn what the court rule requires in connection with specific recordkeeping issues, including handling unclaimed, unidentified and disputed funds, and other dilemmas which can arise while safeguarding client funds, as well as some insights on the rise in attorney trust account fraud.
This comprehensive course also provides an understanding of the Interest on Lawyer Trust Accounts (IOLTA) program, and participants will explore the history and basic concepts of IOLTA, the mandatory requirements for attorneys under rules such as New Jersey Court Rule 1:28A, and the critical role IOLTA funds play in supporting civil legal aid and access-to-justice initiatives. The curriculum covers practical aspects of compliance, including proper account setup, management for multi-jurisdictional firms, annual registration procedures, and the serious consequences of non-compliance, including attorney ineligibility.
The program will wrap up with an overview of what to expect if you are selected for a random compliance audit.
Join speakers from the Office of Attorney Ethics and the IOLTA Fund of New Jersey as they present a program that goes beyond the basics to discuss the handling of IOLTA accounts, proper preparation of trust and business account records, as well as an overview of the more common recordkeeping mistakes made by attorneys.
