As workplaces become more diverse in how employees think, communicate, and process information, HR professionals and employment attorneys increasingly encounter issues involving neurodivergent employees, including those with autism, ADHD, dyslexia, and other cognitive differences.
This seminar examines how neurodiversity can affect workplace investigations, litigation, administrative complaints, reasonable accommodation requests, misconduct allegations, and performance management. A panel of practitioners will explore how differences in communication, sensory processing, executive functioning, and social interaction can influence interviews, credibility assessments, accommodations discussions, and the interpretation of workplace behaviors. The panel will also address the growing role of artificial intelligence, both as a tool neurodivergent employees may request as an accommodation and as a potential source of bias in hiring, performance monitoring, and investigations. The program will identify common missteps that can contribute to bias, mischaracterization, ineffective decision-making, or legal exposure under the Americans with Disabilities Act (ADA), the New Jersey Law Against Discrimination (NJLAD), and related employment laws.
