As artificial intelligence becomes increasingly integrated into legal practice, lawyers must navigate a complex ethical landscape. This program will explore the ethical implications of AI use in litigation, with a focus on available guidance including the Rules of Professional Conduct, recent court decisions, and guidance issued by state and local bar associations. Topics will include the duty of competence in using generative AI tools, confidentiality risks, and the importance of supervision and human oversight to avoid reliance on inaccurate or fabricated outputs. The session will also address cybersecurity vulnerabilities introduced by AI platforms and the cross-border implications of data sharing and AI-generated content.

Attendees will gain practical insights into developing responsible AI policies, supervising AI use within legal teams, and maintaining client trust in an evolving technological environment while remaining in good ethical standing. Concrete take-aways tailored to the needs of litigators and in-house counsel will be explored, and real-world case studies, and legislative and regulatory updates, will ground the discussion in current practice.
