This will be an essential discussion covering:

  • Retainer agreement tips and strategies;
  • Setting a competitive hourly rate. What is reasonable?;
  • New Jersey contingent fee agreement rules 1:21-7; RPC 1.5(b);
    • Ethical issues when interfacing with the client- reasonable fees R. 1:21-7 and ethical requirements under RPC 1.5;
  • The pros and downsides of contingency fees;
  • When is a retainer agreement unenforceable?;
  • Offers of Judgment;
  • The Balducci v Cige decision - including, ethical issues and relevant RPCs; and
  • A review of current caselaw involving retainer agreements.
