The Right Stuff – Hiring Staff to Ensure Firm Growth and Success

This panel will be presented and moderated by an immigration law attorney who will describe her small firm’s decision to hire an office manager and how hiring that person has not only increased the firm’s overall profitability but also positioned her firm to handle the current wave of new immigration law clients. Other panelists will describe how virtual services are helping their firms to grow. Finally, panelists will discuss new technology and if AI/GAI can be used to streamline or replace functions.

Prosecuting Outside the Box: Inspiration and Innovation

Criminal Litigation Track (Aqua)

Like many prosecuting agencies, the Atlantic County Prosecutor’s Office has experienced an increase in cases and backlog due to Covid-era policies, increases in lower-level, quality-of-life offenses, spikes in juvenile crime, the impact of bail reform, new laws and directives as to drug prosecutions, and much more. The tools available through statute and court rule—Recovery/Drug Court, probation supervision, and supervised release—have not sufficiently met this wave. It was in that context that, in 2022, this agency’s newly appointed County Prosecutor and staff began meeting with outside agencies, businesses, social service organizations, residents and community leaders—each seeking relief from a perpetual cycle of property and occasionally violent crimes, often by the same offenders. By working together with all stakeholders and gathering intelligence, ACPO led an effort that has resulted in the implementation of multiple new prosecutor-led diversion programs that utilize prosecutorial discretion and lean on outside help to create new solutions and approaches to helping both suspects and those impacted by their crime. The presentation will introduce the problem(s) as encountered through direct community engagement and describe in detail the programs that were created, the role of courts, defense, and outside agencies, data and discernable impact thus far. An emphasis will be placed on a violence-interruption diversion program that provides trauma-informed therapy to juveniles and young adults, with input from the providing agency on that program and their experience helping develop prosecutor-led diversion programs across the nation.

Clients, Culture and the Bottom Line: Why DEI Matters in Law Practice

Solo and Small-Firm Track (Studio 3)

In today’s evolving legal landscape, it is more important than ever for attorneys to understand how to work effectively with clients from diverse backgrounds and perspectives. Cultural competence and a strong foundation in Diversity, Equity, and Inclusion (DEI) principles are not only ethical imperatives but also business advantages. This program will begin by exploring the importance of recognizing and addressing implicit biases—those often-unconscious presumptions and inclinations that can impact how clients are perceived and treated. Lawyers will gain tools to better connect with clients, maintain strong attorney-client relationships, and represent their clients effectively and ethically across cultural and ideological divides. Building on this foundation, the program will then shift to the practical application of DEI in the business and operational side of legal practice. Attendees will learn about DEI certifications available to law firms, including the process of obtaining and maintaining them. The program will further explore strategic advantages and leveraging DEI-focused opportunities, including trade shows and corporate vendor programs, to grow your practice. The program will also examine the implications of recent Executive Orders on DEI certifications and explore how legal professionals can leverage these developments to expand their networks, enhance business development, and lead with inclusivity. This comprehensive session will provide both the ethical insight and practical strategies needed to integrate DEI into your legal practice meaningfully and effectively.

What Every Attorney Should Know About the Impact of Criminal Charges on Immigration Status and Detention in New Jersey

Immigration Track (Studio 2)

This program will delve into the crossover between immigration and criminal law. This crossover is complex and requires a unique set of strategies to get the best results for your clients. Criminal matters can impact an individual’s immigration status and have life-altering ramifications for your clients. Before deciding to represent a non-United States citizen, attorneys must understand the consequences criminal charges and convictions can have on an individual’s immigration status and know how to proceed in a criminal matter, when and if your client is detained by ICE. The panelists will offer guidance on how to prepare cases for foreign nationals facing removal for crimes. The panel will also cover the nuts and bolts of the process of apprehension by federal immigration authorities – who is brought into detention, why they are being detained, and where people are ending up. It will also cover the practicalities (and ethical responsibilities) of representing someone in detention in collateral proceedings, including accessing criminal court proceedings while detained, information on communicating with your client, and connecting them with other resources.

Employment Arbitration Practice Points: Dispositive Motion Practice and in Arbitration and Award Enforcement

Dispute Resolution Track (Studio 2)

This panel will discuss a range of issues, including vacating and enforcement of arbitration awards. It will examine recent decisions including Newark Fire Officers Union Local 1860 v. City of Newark that raised questions regarding the authority of the federal and state courts and the standards to be applied in both labor and employment arbitration cases for enforcing or vacating arbitration awards. This distinguished panel of labor and employment law arbitrators will discuss those standards and share practice tips. It will also cover dispositive motions in labor and employment arbitration, such as motions to dismiss or summary judgement are commonplace during pre-hearing proceedings in employment arbitration or for statutory claims of discrimination raised arising under collective bargaining agreements. While not as common pre-hearing for non-statutory claims in traditional labor arbitrations, motions are a frequent tool for raising procedural or substantive defenses to arbitrability during the hearing itself. Join our distinguished panel of labor and employment arbitrators as we discuss how and why we rule on such motions, and how best to position your arguments and the evidence.
