Since the enactment of the New Jersey Law on Notarial Acts on Oct. 22, 2021, notarial officers have been authorized to perform remote online notarizations (RONs) and remote ink notarizations (RINs), significantly expanding the ways documents can be executed and notarized.
The law permits New Jersey notarial officers to notarize: (1) electronic documents signed by an individual in the physical presence of the notarial officer (e-notarizations), and (2) both paper and electronic documents through approved communication technology when the signer and notarial officer are in different locations (RONs and RINs). The statute also establishes the requirements and procedures for becoming a remote notary.
While these developments have increased convenience and efficiency, they have also created new opportunities for costly mistakes. An improperly performed notarization can result in the rejection of documents by government agencies, challenges to admissibility in court, delays in closing transactions, or even the invalidation of the underlying legal agreement. Just as importantly, defective notarizations may undermine the legal presumption that signatures are authentic and executed voluntarily.
This program will provide attorneys and notaries with a practical overview of New Jersey's remote notarization framework, including the requirements for becoming and serving as a notary public. The presenters will examine both common and often-overlooked errors that can compromise the validity of a notarization and create significant problems for clients, transactions, and litigation matters. Attendees will leave with a clearer understanding of how to navigate remote notarization requirements and avoid mistakes that can have serious legal and financial consequences.
