NEW BRUNSWICK – A much-anticipated special master's report on the Alcotest agreed with a position the NJSBA has argued as an amicus.
The Special Master's report in State v. Cassidy concluded that use of the NIST-traceable thermometer during the calibration process is necessary for Alcotest readings to be scientifically reliable and admissible into evidence, a position the NJSBA has consistently held. The case could have wide-spread implications and all of the parties, including the NJSBA, have 30 days to submit additional briefs.
