What About Fido? A Discussion of Issues Relating to the Intersection Between Pets and Family Law

Family Law, Special Interest Track (Central Meeting Room 2/3)

Family law intersects with animal law in cases of divorce (FM), nondissolution (FD) and domestic violence (FV); these cases are handled in Family Court while other pet custody cases are docketed in the Law Division. There will be a discussion of whether an enhanced status for animals will affect pet custody cases in the future, leading to issues regarding the best interests of the animal. The speakers will also address the topic of pets in the context of domestic violence and the emerging torts of negligent or intentional infliction of emotional distress through the owner’s act of witnessing an animal’s injury or death. Panelists will focus on the substantive issues influencing a court's decision on possession of a domestic companion animal in these various contexts, as well as considerations of venue and jurisdiction. The panelists are highly experienced family law practitioners and members of the Animal Welfare Committee, a group dedicated to protecting the health and welfare of the animal population. Victims and witnesses who are survivors of violence (sexual, emotional and physical abuse) are often reluctant to cooperate with attorneys and testify in court proceedings. Many times they are suffering from Post-Traumatic Stress Disorder or through their previous experiences, have been re-victimized by justice systems that were not properly equipped to adapt to the rights and needs of such survivors. As legal professionals we have been educated on the law and procedures, but many attorneys and judges often lack specialized training in dealing with such victims and witnesses. Related procedures are sensitive to proper methods of questioning these individuals without putting them on the defensive and further causing harm. New Jersey False Claims Act

New Jersey just amended its False Claims Act. It provides for treble damages, fines and penalties of up to $22,000 per claim, and the defendants have to pay the whistleblower’s attorneys fees and costs, and NJ is chockablock with pharmaceutical companies, biotech, health care startups and defense contractors where this comes into play. To make attorney ethics and professional responsibility less theoretical, the panel will present excerpts of popular movies and television shows portraying real world immigration issues and their related ethical dilemmas. Immigration law as portrayed in pop culture is often filled with myths and falsehoods, wherein clients seem to engage in the legal system with little or no attorney guidance, committing fraud and misrepresentation, violating immigration laws, engaging in unlawful employment practices, and potentially human trafficking. This panel will show Solo and Small Firm attorneys who may not be familiar with using social media some of the tools they can use to reach new clients ethically.
