There will be a discussion of whether an enhanced status for animals will affect pet custody cases in the future, leading to issues regarding the best interests of the animal. The speakers will also address the topic of pets in the context of domestic violence and the emerging torts of negligent or intentional infliction of emotional distress through the owner’s act of witnessing an animal’s injury or death. Panelists will focus on the substantive issues influencing a court's decision on possession of a domestic companion animal in these various contexts, as well as considerations of venue and jurisdiction. The panelists are highly experienced family law practitioners and members of the Animal Welfare Committee, a group dedicated to protecting the health and welfare of the animal population. How to Deal with Survivors and Victims of Crimes as Clients/Witnesses and Litigants Without Burning Out
Criminal, Family Law, Well-Being Track (Central Meeting Room 1)
Victims and witnesses who are survivors of violence (sexual, emotional and physical abuse) are often reluctant to cooperate with attorneys and testify in court proceedings. Many times they are suffering from Post-Traumatic Stress Disorder or through their previous experiences, have been re-victimized by justice systems that were not properly equipped to adapt to the rights and needs of such survivors. As legal professionals we have been educated on the law and procedures, but many attorneys and judges often lack specialized training in dealing with such victims and witnesses. Related procedures are sensitive to proper methods of questioning these individuals without putting them on the defensive and further causing harm. It is our duty to ensure that they understand their access to justice and guide them past the impediments and obstacles such as lack of knowledge about their rights and legal representation. Each presenter will share their experiences with dealing with such survivors and victims and give insight and techniques to help other legal professionals represent such individuals in an effective, compassionate, fair and humane manner while ensuring that we as attorneys do not burn out or do so to our detriment.Access Seminar MaterialsCLE Credits For This Program:

Now Daubert, Now What?
Civil Litigation , Criminal Track (Central Ballroom CD)
The Supreme Court of New Jersey recently adopted in State v. Olenowski a state law version of the Daubert framework to evaluate the admissibility of expert testimony in criminal cases under N.J.R.E. 702. Why is this change in the law, which parallels the Court’s previous adoption of Daubert factors in civil cases, important? How might it affect admissibility challenges to experts for either the prosecution or the defense moving forward? In this presentation, a leading Evidence law scholar, judges, and practitioners from the State and the Office of the Public Defender will discuss the traditional use of forensic science in criminal and quasi-criminal cases in federal and state courts, spotlight key facets of the Olenowski opinions, and consider what the future might bring under the Daubert CLE Credits For This Program: Access Seminar MaterialsCLE Credits For This Program:

As a Solo and Small Firm practitioner, you need to make sure that you are providing a physically secure environment for yourself, your clients, and your staff. Panelists will discuss the following: 1) What physical security measures are appropriate for the office? For instance, can you install a security camera at the point of entry or any other parts of the office to monitor the comings and goings of visitors/clients? 2) What federal and state privacy laws are impacted here? 3) What are the restrictions on recording employees? 4) Does capturing a client on camera in for an office visit a violation of attorney client privilege? Is it potentially discoverable evidence? 5) Are there other lesser security measures that can be taken? What about obtaining a security assessment from a consultant or perhaps giving some basic safety training to staff? 6) What kind of disclosures on these security measures need to be made to clients and/or staff? Ethics and Immigration (Entertaining Ethics)
Ethics, Immigration Track (Central Meeting Room 2/3)
This panel will use the portrayal of immigration law in film (The Proposal and The Terminal) and television (Superstore) as a springboard to discuss an attorney’s ethical obligations and professional responsibilities. To make attorney ethics and professional responsibility less theoretical, the panel will present excerpts of popular movies and television shows portraying real world immigration issues and their related ethical dilemmas. Immigration law as portrayed in pop culture is often filled with myths and falsehoods, wherein clients seem to engage in the legal system with little or no attorney guidance, committing fraud and misrepresentation, violating immigration laws, engaging in unlawful employment practices, and potentially human trafficking. Where are the attorneys in all of this? If these were your clients, what would you, as an attorney advise? The panel will discuss and debate an attorney’s ethical obligation and professional responsibilities in each scenario. NOTE: Justice Noriega is a Justice of the New Jersey Supreme Court. Insta What?? Using Social Media to Ethically Build Your Brand
Ethics, Law Practice Management, Solo and Small-Firm, Technology Track (Luna)
There is no question that social media is a growing force for reaching clients and building a brand. This panel will show Solo and Small Firm attorneys who may not be familiar with using social media some of the tools they can use to reach new clients ethically. Specifically, panelists will demonstrate the following: 1) What a LinkedIn profile is, the type of information that should be posted on LinkedIn, and how LinkedIn can be used to reach potential new clients 2) What InstaGram is, the types of postings that can be made, and how it can be used to reach new clients 3) X (formerly Twitter) and TikTok – these present special challenges for attorneys but do reach a younger potential clientele base After these social media tools are demonstrated, panelists will then discuss (i) how you can use them and how the rules on attorney advertising and ethics apply to them and any pitfalls you need to be aware of, plus (ii) how to avoid the “appearance of impropriety.” Just because an attorney can do something, does not always mean they should. The appearance of impropriety is an important concern as well, especially if we want to maintain standards in our profession.Access Seminar MaterialsCLE Credits For This Program:

Cancel Culture: New First Amendment Challenges in Media and Employment Law
Labor & Employment, Special Interest Track (Studio 3)
“Cancel Culture” is a cross partisan phenomenon born of social media, which has migrated into the workplace. In Netchoice v. Paxton case, wherein the United States Supreme court will have to confront whether the First Amendment prohibits states from interfering with social media platforms, is just the tip of the iceberg. Some say that protecting the most vulnerable requires reimagining our free speech values, while others may argue that “Cancel Culture” is just the latest form of the kind of censorship the U.S. Constitution rejects. The panel will explore the first amendment implications of Cancel Culture in social media and the workplace and the immensely complicated and monumental issues it poses in our increasingly polarized workplaces and society at large.Access Seminar MaterialsCLE Credits For This Program:

Doing Deals in the Garden State
Business and Taxation, Labor & Employment, Real Estate Track (Central Meeting Room 2/3)
Mergers and acquisitions – buying and selling businesses and business assets – entail a complex blend of business savvy, market knowledge, process familiarity, and substantive legal skills. For lawyers engaged in M&A deals, they must not only be in command of all the corporate law nuances that go into a purchase or merger agreement, but also have familiarity with (or access to other lawyers familiar with) the relevant tax, employment, environmental, and other legal issues that frequently arise in these deals. And while many transactions nationwide are governed by Delaware or New York law, deals involving New Jersey-based owners or businesses will inevitably drag in legal issues in each of these areas that are peculiar to the Garden State. This panel brings together corporate, tax, employment, and environmental attorneys from around the state to share their expertise regarding some of these key NJ legal issues that arise when doing deals.Access Seminar Materials CLE Credits For This Program:

The Evolving Role of Government in Environmental Litigation
Special Interest Track (Central Meeting Room 1)
In both state court and federal courts, New Jersey practitioners are seeing an uptick of government-led and government-involved litigation involving emerging and expanding theories of liability and damages. Many of these actions involve so-called emerging contaminants, or contaminants for which new standards are being set. Our experienced panel of litigators will discuss and examine the changing landscape in environmental law, and preview what New Jersey attorneys may expect to see as the government’s role in environmental litigation continues to evolve.Access Seminar Materials
