On Wednesday June 5, Governor Murphy signed S2930/A4045 which will drastically change New Jersey’s Open Public Records Act (OPRA).

The sponsors of the bill state that it contains much needed reform because the law currently puts an undue burden on municipal clerks and others who are tasked with providing records under the act, and that it will save the taxpayers money. Opponents of the bill aver that the reforms “gut” the law, and that the legislation limits the ability of the public to obtain currently accessible records.

Join attorneys with experience in OPRA proceedings and in representing municipal, county and state governments as they help you navigate the proposed new law.

Topics include:

  • The New and Broader Exceptions to the Definitions of Public Records
  • Expanded Privacy Protections
  • New Requirement for the Use of Forms
  • New Cause of Action for Public Agencies Against Requestors
  • Limits on the Right to Proceed Anonymously in Superior
  • Limits on the Use of OPRA when related to a pending legal proceeding
  • Published Cases Reversed by the Amendments
  • New Burden of Proof in Special Service Charge Cases
  • New Rules for Commercial Requestors
  • Effective Dates and Pipeline Retroactivity
