A Look Behind the Curtain: Insights into How Different Stakeholders in Employment Mediations Evaluate Claims for Settlement

Dispute Resolution, Labor Track (Tides)

Our program will be a look at points of view around the mediation table. Labor & Employment Lawyers settle 99% of their cases in mediation so gaining an understanding of the dynamics of the negotiations from the other parties' perspective is essential to a successful resolution. It is enlightening for parties and litigation counsel who are in settlement discussions to hear what the other side is thinking behind the curtain and what is driving the numbers. Cancel Culture: New First Amendment Challenges in Media and Employment Law

Labor, Special Interest Track (Studio 3)

“Cancel Culture” is a cross partisan phenomenon born of social media, which has migrated into the workplace. In Netchoice v. Paxton case, wherein the United States Supreme court will have to confront whether the First Amendment prohibits states from interfering with social media platforms, is just the tip of the iceberg. Some say that protecting the most vulnerable requires reimagining our free speech values, while others may argue that “Cancel Culture” is just the latest form of the kind of censorship the U.S. Constitution rejects. The panel will explore the first amendment implications of Cancel Culture in social media and the workplace and the immensely complicated and monumental issues it poses in our increasingly polarized workplaces and society at large.CLE Credits For This Program:

Doing Deals in the Garden State

Business and Taxation, Labor, Real Estate Track (Central Meeting Room 2/3)

Mergers and acquisitions – buying and selling businesses and business assets – entail a complex blend of business savvy, market knowledge, process familiarity, and substantive legal skills. For lawyers engaged in M&A deals, they must not only be in command of all the corporate law nuances that go into a purchase or merger agreement, but also have familiarity with (or access to other lawyers familiar with) the relevant tax, employment, environmental, and other legal issues that frequently arise in these deals. And while many transactions nationwide are governed by Delaware or New York law, deals involving New Jersey-based owners or businesses will inevitably drag in legal issues in each of these areas that are peculiar to the Garden State. This panel brings together corporate, tax, employment, and environmental attorneys from around the state to share their expertise regarding some of these key NJ legal issues that arise when doing deals. CLE Credits For This Program:
