85 Years After Krystallnacht, How Lawyers Can Fight Hate and Prevent Genocide

On Nov. 7, 1938, in Paris, a young Jewish man whose family had been displaced by antisemitism from Poland, and then from Nazi Germany, entered the German embassy and assassinated an antisemitic German diplomat. His action precipitated, a mere two days later, the event known as Krystallnacht, perhaps the first flash mob in history, in which spontaneous riots, vandalism, and murders against Jews throughout Germany and Austria erupted. In fact, his act merely provided a pretext for a purge that had been planned and merely awaited its occasion.
Krystallnacht, and the Holocaust it foreshadowed, established a genocidal pattern that has been repeated in other contexts in the years since the Holocaust: in Cambodia, Rwanda, Kosovo, and other locations. Unfortunately, with the rise of hate on social media, the pattern has the potential to accelerate and erupt in many locations throughout the world.
This session will explore the progression from hate speech to genocide, both historically and in its current setting, by speaking with the current U.N. Undersecretary For Genocide Prevention, Alice Nderatu, Dr. Joel Finkelstein, a pioneering researcher on the spread of hate speech on the internet, and experts on the historic role of lawyers in both preventing genocide and, in unfortunate cases, making it legally possible. It will highlight the work of Rutgers’ Eagleton Institute’s Miller Center, the Network Contagion Research Institute, and the UN in raising awareness of these issues and providing early warning in an effort to prevent tragedy.
