Understanding Apportionment in Joint Tortfeasor and Successive Tortfeasor Cases

The Comparative Negligence Act and the Joint Tortfeasor’s Contribution Law provide remedies to injured parties as well as tortfeasors. However, the right to apportion may vary when there are joint tortfeasors versus successive tortfeasors. The Tort Claims Act, bankruptcy, lack of personal jurisdiction, and the worker’s compensation bar may also affect how apportionment of liability will apply in a personal injury matter. Recent Developments in Class Actions

The past year has seen important developments in class action law, and the federal and state courts in New Jersey continue to be a very active battleground for class action practice. In addition, there have been decisions in other jurisdictions that may impact class actions in the District of New Jersey. This panel of leading class action practitioners will discuss some of the developments and trends of interest to both plaintiffs’ and defense counsel who practice or wish to practice in this area. The panel shall address the following topics: Recent Developments in the law governing arbitration agreements, class action waivers in arbitration agreements and stand-alone class action waivers as well as the rise of mass arbitrations, including: (i) the New Jersey Supreme Court’s decision in Pace v. Hamilton Cove; (ii) the Appellate Division’s decision in McGinty v. Zheng; (iii) the status of the mass arbitration rules enacted by the American Arbitration Association and JAMS; and (iv) an update on what's happening in mass arbitrations; Recent developments in data breach and privacy class actions; Problems encountered with the rise of claims fraud in the administration of class settlements, and issues relating to digital payment of class benefits; The ramifications, if any, of Robey v. SPARC Group, LLC, on the ascertainable loss requirement for Consumer Fraud Act claims; and, May a federal court certify a class when some members purportedly lack Article III injury.
