What Every Employer Needs to Know When Faced with Worksite Immigration Enforcement
Immigration Track (Central Meeting Room 2/3)
Immigration enforcement is at an all-time high under the current administration, leaving employers and employees alike in a vulnerable and uncertain situation. Virtually all employers are subject to an unexpected visit from federal agencies seeking to inspect their records, access employees, or even detain and arrest individuals. Employers should be proactively preparing and instructing employees what to do, and what not to do, in advance so that if the unexpected raid happens, they aren’t caught completely off guard. Objectives: 1. -learn how the Federal Government enforces immigration (I-9 inspections, Raids, visa compliance checks) 2. -learn how to determine if the Federal Government is authorized to enter the workplace 3. -learn how to help employers develop immigration preparedness plans 4. -learn the Do’s and Don’ts of interacting with government officials, from ICE to the FBI 5. -learn how employers can support employees without violating the law themselves

Issues Faced by Noncitizens in NJ Criminal Courts
Immigration Track (Studio 4)
A discussion of the unique experience of noncitizens as victims, witnesses, and accused, in New Jersey's criminal courts. The panelists will address U visa protections for victims, ensuring access to courts for witnesses including through the use of virtual appearances, and the expansive constitutional mandate to provide Padilla advice to accused noncitizens in both municipal and superior courts. The panelists will also discuss the shared interests of prosecution and defense in serving the noncitizen community in New Jersey.

What Every Attorney Should Know About the Impact of Criminal Charges on Immigration Status and Detention in New Jersey

This program will delve into the crossover between immigration and criminal law. This crossover is complex and requires a unique set of strategies to get the best results for your clients. Criminal matters can impact an individual’s immigration status and have life-altering ramifications for your clients. Before deciding to represent a non-United States citizen, attorneys must understand the consequences criminal charges and convictions can have on an individual’s immigration status and know how to proceed in a criminal matter, when and if your client is detained by ICE. The panelists will offer guidance on how to prepare cases for foreign nationals facing removal for crimes. The panel will also cover the nuts and bolts of the process of apprehension by federal immigration authorities – who is brought into detention, why they are being detained, and where people are ending up. It will also cover the practicalities (and ethical responsibilities) of representing someone in detention in collateral proceedings, including accessing criminal court proceedings while detained, information on communicating with your client, and connecting them with other resources.
