The immigration courts are housed in an agency of the U.S. Department of Justice. Scholars have debated for thirty years regarding whether the courts themselves should be independent of an executive department. This is not a political issue—this is an issue of independent fair hearing, due process and legal precedent stability. This presentation will not advocate any political candidate, policy or issue.
This academic discussion will highlight:
- The history of the immigration court
- The regulatory process of Attorney General certification of precedential cases such as Matter of A-T- and Matter of A-B-
- Pros and cons of an independent court
