Under New York State Rifle & Pistol Association v. Bruen (2022), a gun law is typically unconstitutional unless similar laws existed in the framing era. Now there is a new case in front of the US Supreme Court: United States v. Rahimi. The specific question before the Supreme Court is whether 18 U.S.C. 922(g)(8), which prohibits the possession of firearms by persons subject to domestic violence restraining orders, violates the Second Amendment on its face. The case presents an interesting aspect of the Second Amendment because when you take the historical record into consideration, there were no bans on gun ownership by domestic abusers in 1791.
