Am I Covered? – Understanding Your Professional Liability Policy and Trending Claims

This seminar promises to reach a broad range of interested people, including: managing partners and/or other attorneys responsible for securing and/or renewing legal malpractice insurance and informing the carrier of potential claims and who need to know whether certain acts or omissions are covered under the firm’s professional liability policy; new and experienced attorneys who need to learn when to advise of a potential claim; and non-attorneys within law firms responsible for securing and/or renewing insurance policies and/or reporting claims. This seminar will provide an understanding of professional liability coverage for attorneys and law firms, including scope of coverage, what may be a claim, claims-made policies, responsibilities for providing notice, and the significance of the timing of reporting a claim. Next, the panelists will delve into several real life, “trending” scenarios or hypotheticals and discuss whether coverage would be provided under a legal malpractice or other type of policy. The topics to be discussed include the following: whether acts or omissions of non-lawyers, including paralegals and legal assistants, are covered; cyber risks and exposures (to self, firm, clients, third parties, and vendor risk considerations), and artificial intelligence risks and exposures, as well as ethical implications.

Navigating Proposed Amendments to Requirements for the Remediation of Contaminated Sites and Development
Environmental Law Track (Central Meeting Room 1)
In October 2024, the NJDEP issued a proposed rule pitched as aligning the ARRCS, N.J.A.C. 7:26C, and the Technical Requirements, N.J.A.C. 7:26E, with the Aug. 23, 2019, statutory changes to the Site Remediation Reform Act (SRRA 2.0). Chief among those revisions were changes to the ARRCS requiring disclosure of discharges discovered during pre-closing due diligence by prospective purchasers of real property to both the property owner and NJDEP. Such disclosure obligation marks a distinct change in the handling of all appropriate inquiry driven diligence. The purpose of this panel is to not only review the challenges associated with such change – including but not limited to those concerns raised by the comments to the proposed rule – but to discuss strategies for helping clients adapt to this new paradigm.

Recent Developments in Class Actions
Civil Litigation Track (Studio 4)
The past year has seen important developments in class action law, and the federal and state courts in New Jersey continue to be a very active battleground for class action practice. In addition, there have been decisions in other jurisdictions that may impact class actions in the District of New Jersey. This panel of leading class action practitioners will discuss some of the developments and trends of interest to both plaintiffs’ and defense counsel who practice or wish to practice in this area. The panel shall address the following topics: Recent Developments in the law governing arbitration agreements, class action waivers in arbitration agreements and stand-alone class action waivers as well as the rise of mass arbitrations, including: (i) the New Jersey Supreme Court’s decision in Pace v. Hamilton Cove; (ii) the Appellate Division’s decision in McGinty v. Zheng; (iii) the status of the mass arbitration rules enacted by the American Arbitration Association and JAMS; and (iv) the limits of Mass Arbitration Protocol as recognized by the Ninth Circuit in Heckman v. Live Nation Entertainment, Inc.; Recent developments in data breach and privacy class actions; Problems encountered with the rise of claims fraud in the administration of class settlements, and issues relating to digital payment of class benefits; The ramifications, if any, of Robey v. SPARC Group, LLC, on the ascertainable loss requirement for Consumer Fraud Act claims; and, May a federal court certify a class when some members purportedly lack Article III injury.
