Most employment cases resolve voluntarily in mediation or settlement negotiations attendant to mediation. But cases don’t settle themselves. This program features practitioners representing the various stakeholders common to the vast majority of employment disputes: plaintiff’s counsel, defense counsel, and the mediator. The panelists will engage in an interactive discussion about the strategies that appear to be most effective for reaching a favorable resolution, common missteps, tips for effective negotiations, insights into case valuation, the potential impacts of other jury verdicts, and other considerations.

The past year saw the passage of new laws mandating the pay transparency by employers; attacks on diversity programs of both public and private entities; the expansion of disability and pregnancy accommodation claims and requirements; and new rules issued by the EEOC updating guidance on workplace harassment. This program seeks to provide legal updates on recent legal developments in these areas of the law and anticipate their impact in both the near and foreseeable future.

Changes in Employment Law Updates: Administration’s ‘Shock and Awe’ Approach meets the Rule of Law
Labor & Employment Track (Central Meeting Room 2/3)
The second Trump administration’s “shock and awe” strategy includes plans to revolutionize the worlds of public and private employment – with strategies that will be tested in the Courts. We provide the latest updates on such initiatives as efforts to redefine the structure of the Federal Civil Service, enhanced immigration enforcement in the workplace, changes to wage and hours regulations, the impact on the National Labor Relations Act and its governing Board and shifting the role of the EEOC and attempting to roll back DEI. Questions will include whether the Presidential Administration’s civil service changes violate the First Amendment, whether the immigration crackdown can survive due process challenges, and whether changes to the administration of employment and anti-discrimination laws will survive challenges. The discussion from leading experts in the field will include review of the latest US Supreme Court cases on these subjects.
