DWI Update 2025
Municipal Court Track (Waves)
Overview: Join us for the DWI Update 2025, a comprehensive seminar focusing this year's changes in DWI representation, discovery, post-conviction relief, plea bargaining, and breath testing. It will also examine immigration, with the advent of the present administration in Washington, D.C., immigration law now provides that any alien-whether a green card or visa holder or undocumented-faces deportation and is rendered inadmissible if convicted of DWI. Learn how our courts are protecting the administration of justice in light of threats to immigrants facing this serious traffic offense in New Jersey. It will also cover post-conviction relief, especially in light of State v. Zingis, where PCR is no longer an unusual extraordinary remedy for unconstitutional convictions, but a requirement for those previously convicted in cases involving Alcotest 7110 breath testing instruments inspected by for breath test coordinator Marc Dennis. Another topic will be prior convictions looking at State v. Zingis and Erlinger v. United States, two recent cases discussing the state's burden in establish the validity of prior convictions and suggesting yet more options in plea negotiations. And it will cover new breath testing technology, where State v. Cunningham proceeds apace as the State seeks to validate use of the Alcotest 9510, now replacing the Alcotest 7110. While no decision is expected until next year, we'll get you up-to-date on the current status. Join us!
