More and more homes contain smart devices: Amazon Alexa, Google Home, Nest Thermostat, smart TVs, Roombas, and more. These devices store all kinds of activities and transmit that data to the cloud. In this brand-new seminar, explore the types of data available, look at cases where that data was used, and discuss the law regarding the collection of this type of data.
From there, dive into the ethics surrounding the usage of the electronically stored information from these devices, including electronic discovery and the related ethical duty of competence. Drawing on guidance from the New Jersey State Bar Association, recent e-discovery cases, and experience, this presentation outlines the main risks to counsel and client of failing to properly understand e-discovery obligations in litigation.
